1. Acceptance of Terms

By accessing or using Microlab (“App”), you agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree, you must not use the App.

These Terms apply to all users, including students, educators, and institutions.


2. Eligibility

You must be at least:

  • 13 years old in Ireland, or
  • the minimum legal age required in your country (if higher)

to use Microlab.

If you use the App on behalf of an institution, you confirm that you have authority to bind that institution to these Terms.


3. Scope of Use and Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use Microlab for:

  • personal educational use
  • self-directed learning
  • teaching or training use (for authorised educators or institutions)

You must not:

  • resell, sublicense, or commercially exploit the App
  • copy, modify, or reverse engineer the App
  • misuse the App in violation of applicable laws
  • share your account credentials with unauthorised users

Institutional, classroom, or bulk access may require a separate licence or agreement.


4. Account Registration and Security

To access certain features, you may be required to create an account.

You agree to:

  • provide accurate and complete information
  • keep your login credentials secure
  • be responsible for all activity under your account

We are not responsible for unauthorised access caused by failure to secure your account.


5. Subscriptions, Billing and Cancellation

Microlab offers paid subscriptions (monthly and yearly).

By subscribing, you agree that:

  • payments are charged in advance based on your selected plan
  • subscriptions automatically renew unless cancelled before renewal date
  • you can cancel at any time through your app store (Apple App Store / Google Play) or account settings where available
  • cancellation takes effect at the end of the current billing period

EU Consumer Rights (Cooling-Off Period)

If you are located in the European Union, you may have a statutory 14-day right of withdrawal for digital services.

However, if you begin using the service immediately after purchase, you acknowledge that you may lose this withdrawal right where permitted by law.

Refunds are handled in accordance with applicable EU consumer law and platform policies.


6. Acceptable Use

You agree not to:

  • use the App for illegal, harmful, or abusive purposes
  • upload offensive, infringing, or unlawful content
  • attempt to hack, disrupt, or reverse engineer the App
  • impersonate any person or entity
  • violate academic integrity rules applicable to your institution

We may suspend or terminate access for violations of these Terms.


7. Educational and Medical Disclaimer

Microlab is an educational platform only.

It does not provide:

  • medical advice
  • clinical diagnosis
  • treatment recommendations
  • emergency or healthcare services

Microlab must not be used as a substitute for professional medical judgement, clinical training, or patient care decisions.


8. AI-Generated Content Disclaimer

Microlab includes AI-powered educational tools such as:

  • quizzes
  • flashcards
  • summaries
  • explanations

You acknowledge that:

  • AI outputs may be incorrect, incomplete, or outdated
  • outputs are for educational support only
  • Microlab does not guarantee accuracy or reliability of AI-generated content

You are responsible for independently verifying information before relying on it.


9. Intellectual Property Rights

All content and materials in the App, including but not limited to:

  • software, code, design, and interfaces
  • text, images, slides, and diagrams
  • branding, logos, and trademarks

are owned by Microlab or its licensors and protected by intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works without prior written permission.


10. User-Generated Content

If you submit or upload content to Microlab, you:

  • retain ownership of your content
  • grant Microlab a worldwide, non-exclusive licence to store, display, and use such content solely for operating and improving the App

We may remove content that violates these Terms or applicable laws.


11. Third-Party Services

Microlab may use third-party services, including:

  • Firebase (backend infrastructure)
  • Zoho (communication tools)
  • CatRevenue or similar billing providers
  • Apple App Store / Google Play billing systems

These third parties operate under their own terms and privacy policies. Microlab is not responsible for their services.


12. Privacy and Data Protection

Your use of Microlab is also governed by our Privacy Policy.

We process personal data in accordance with:

  • the General Data Protection Regulation (GDPR)
  • Irish data protection law

We collect and use data to:

  • operate and improve the App
  • provide accounts and subscriptions
  • ensure security and prevent misuse

13. Service Availability

We do not guarantee uninterrupted or error-free operation of the App.

We may:

  • modify
  • suspend
  • discontinue
    any part of the App at any time without liability.

14. Termination

We may suspend or terminate your access if:

  • you breach these Terms
  • your subscription expires or is cancelled
  • required by law or for security reasons
  • we reasonably determine misuse of the App

You may delete your account at any time.

Upon termination, access to content or data may be removed in accordance with legal and operational requirements.


15. Limitation of Liability

To the maximum extent permitted by applicable Irish and EU law:

Microlab shall not be liable for indirect, incidental, or consequential damages, including loss of data, profits, or educational outcomes arising from use of the App.

Nothing in these Terms excludes liability where such exclusion is not permitted under applicable law (including liability for fraud, gross negligence, or mandatory consumer protections).


16. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis.

We do not guarantee:

  • accuracy of content or AI outputs
  • uninterrupted or error-free service
  • fitness for any particular purpose

17. Changes to Terms

We may update these Terms from time to time.

We will notify users of material changes through the App or website.

Continued use of the App after changes means acceptance of the updated Terms.


18. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland and applicable European Union law.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland, unless mandatory consumer protection laws in your country provide otherwise.
